Terms of Service

These Terms of Service ("Terms") govern your use of the Cash Cage mobile application ("App") provided by Heagen Bell ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Cash Cage is a personal record-keeping tool that allows users to track poker buy-ins, cash-outs, and calculate settlements among players. The App does not facilitate gambling, process real-money wagers, or hold or transfer funds on behalf of any user.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately if you suspect unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Purchases

Cash Cage offers an optional Pro subscription and a lifetime purchase that unlock additional features. The following terms apply:

• Pricing: Subscription prices are displayed in the App at the time of purchase and may vary by region.
• Billing: Subscriptions are billed through the App Store (iOS) or Google Play (Android). Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
• Cancellation: You may cancel a subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
• Lifetime purchase: The one-time lifetime purchase is non-refundable except where required by law.
• Restore purchases: You can restore prior purchases using the "Restore Purchases" option in the App.
• Free tier: Core features remain available on the free tier. We reserve the right to modify which features are included in the free or Pro tiers with reasonable notice.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract the source code of the App.
• Use automated tools to access or scrape the App.
• Impersonate another person or misrepresent your identity.
• Transmit any content that is harmful, offensive, or violates the rights of others.

6. Intellectual Property

All content, design, and software in the App are the property of Heagen Bell or licensed to us. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Nothing in these Terms transfers any intellectual property rights to you.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that any defects will be corrected.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Heagen Bell shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or any inaccuracies in settlement calculations produced by the App. Your sole remedy for dissatisfaction with the App is to stop using it.

10. Indemnification

You agree to indemnify and hold harmless Heagen Bell from and against any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your account at any time from within the App.

12. Changes to These Terms

We may revise these Terms from time to time. We will update the "Last updated" date when we do. Continued use of the App after changes constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict of law principles.
